Gonzalezsarceno v. State, No. 02-25-00042-CR (Sept. 25, 2025) (Walker, J., joined by Sudderth, C.J., and Wallach, J.).

Held:  Texas Code of Criminal Procedure Article 42.015(a) enumerates three offenses for which a trial court shall make an affirmative finding that the victim or intended victim was younger than 17 years of age at the time of the offense.  Because the offense of online solicitation of a minor is not one of Article 42.015(a)’s enumerated offenses, the trial court’s affirmative finding was erroneous.
