Justice Boyd dissents from the denial of Relators’ petition and motion and instead would dismiss both for lack of jurisdiction. See Tex. Const. art. V, §§ 3(a) (providing that this Court’s appellate jurisdiction “extend[s] to all cases except in criminal law matters”), 5(c) (providing that the Court of Criminal Appeals “shall have the power to issue...in criminal law matters, the writs of mandamus, procedendo, prohibition, and certiorari” and “the power to issue such other writs as may be necessary to protect its jurisdiction or enforce its judgments”).
