Register a Guardianship
A court that has probate jurisdiction must provide written notice of the registration requirements to all guardians appointed by that court prior to June 1, 2018.
Each person who qualified as a guardian, in accordance with Section 1105.002 of the Estates Code, before June 1, 2018 must register with the Commission by submitting their guardianship registration application, and their qualification date, via the Commission's online system. This must be completed as soon as possible, but not later than the date their next annual report or annual accounting is due to the court.
Pre-existing guardians are not required to complete the training requirement, unless ordered to do so by the court. In that instance, the guardian must submit a copy of their course completion certificate to the court.
Pre-existing guardians are not required to undergo a criminal history record background check, unless ordered to do so by the court. In that instance, the Commission must provide a copy of the criminal history background check to the county clerk for if the liquid estate value is $50,000 or less.
