Complaint Initiation and Investigation
The Commission, through the Director, may conduct investigations to enforce the laws administered by the Commission.
Filing a Complaint

Clearly describe the allegations you are submitting against the certified professional. to include all documents and materials you believe to support the allegations of your complaint.
When a signed and completed complaint form is submitted, the Commission will determine:
- if the Commission has legal jurisdiction, and
- if the complaint clearly alleges misconduct.
Additional Information Regarding Complaints
- The Complainant's identity is not confidential.
- Anonymous complaints are not accepted.
- A copy of the complaint and any related documentation may be forwarded to the Respondent, including your name and contact information.
- The documents and information provided may be released to the public.
- The name and contact information of the complainant and respondent, a description of the allegations, and relevant documentation should be included in the complaint.

- Documents submitted with the complaint will not be returned to the Complainant; therefore, we recommend complainants maintain a copy of all materials for their records.
The Director may administratively dismiss complaints that:
- clearly do not allege misconduct,
- are not within the Commission’s jurisdiction, or
- allege misconduct which took place more than five (5) years before the complaint was filed.
- The Director must inform the Commission of all dismissals made under this policy at the next regularly scheduled Commission meeting.
- A person who files a complaint that is dismissed by the Director may request in writing that the Commission reconsider the complaint no later than 30 days after the date of notice of the dismissal.
The Commission does not have jurisdiction over non-professional guardians (i.e., family members, friends, etc.); therefore, we are unable to assist in such matters. We recommend that you communicate with the county court where the case was filed for assistance.
Administrative Dismissal Policy
When the complaint is opened for investigation:
- an opening letter is issued to the respondent informing them an investigation has been initiated.
- A copy of the complaint and any attachments are sent to the respondent.
- The respondent is requested to submit an answer to the complaint by mail or email to the Commission within 20 days after receipt of the notice.
- If the respondent is a provisionally certified guardian, the Commission shall also send a copy of the complaint and attachments to the guardian’s supervisor.
As a standard practice, the Compliance Investigator will interview the complainant, the respondent, and pertinent witnesses. The investigator will gather copies of any documents relevant to the complaint.
