Burgess v. City of Westworth Village, No. 02-24-00252-CV (June 19, 2025) (Wallach, J., joined by Kerr and Walker, JJ.).
Held: The jurisdictional evidence submitted to the trial court raised a fact issue about whether Appellee’s taking Appellant’s property and transferring it to a private entity was for the primary purpose of economic development or enhancement of tax revenues, in violation of the 2009 amendments to Article I, Section 17 of the Texas Constitution.
