COURT ADOPTS NEW RULE
FOR INFORMATION GATHERING
IN FAMILY CODE FILINGS
New Civil Procedure Rule 78a requires signed sheet by party filing pleading
The Texas Supreme Court has promulgated a rule requiring a
case-information sheet to be filed in civil cases with an original petition and
with certain post-judgment motions under the Texas Family Code.
Rule 78a becomes effective September 1, with any changes made after a comment
period that ends August 2.
The rule requires that the sheet be signed by an attorney or a party and
provides that the court or court clerk devise appropriate enforcement measures.
But it provides that a pleading may not be rejected if the case-information
sheet is not submitted with it.
Information from the sheet is for data-gathering purposes and does not affect
substantive rights.
